باستخدامك لتطبيق دوا بلس، أنت بتوافق على الشروط والأحكام دي. لو مش موافق على أي جزء، برجاء عدم استخدام التطبيق.
١. تعريفات
- «التطبيق»: تطبيق دوا بلس للموبايل والموقع الإلكتروني.
- «المستخدم»: أي شخص بيستخدم التطبيق لطلب أو البحث عن أدوية.
- «الصيدلية»: أي صيدلية مرخصة مسجلة على المنصة وبتقدم عروض للمستخدمين.
- «الطلب»: أي طلب شراء أدوية أو منتجات صحية عن طريق التطبيق.
- «نحن» أو «دوا بلس»: شركة دوا بلس لإنتاج التطبيقات ش.ذ.م.م (سجل تجاري رقم 33697) — الشركة المشغّلة لتطبيق دوا بلس.
٢. طبيعة الخدمة
دوا بلس منصة وسيطة بتربط المستخدمين بالصيدليات المرخصة الشريكة:
- الصيدلية اللي بتقبل طلبك هي اللي بتبيع المنتجات وبتصرفها من خلال صيدلي مرخّص، وبتتحمل مسؤولية الصرف وجودة المنتجات والتوصيل اللي بتتولاه.
- إحنا بندير المطابقة وعرض عروض الصيدليات ومعالجتها والتواصل والمتابعة والدعم والتسويات بحسب الخدمة المتاحة، وبنسهّل عملية التوصيل بين الصيدلية والمستخدم.
- إحنا مش صيدلية: مش بنوصف ولا نصرف أدوية ولا بنقدّم استشارة دوائية.
- كل طرف مسؤول عن الأعمال اللي بيقوم بيها وعن التزاماته القانونية — ومسؤولية أي طرف بتتحدد وفق القانون والوقائع.
التطبيق مش بديل عن الاستشارة الطبية. دايمًا استشير طبيبك قبل استخدام أي دوا.
٣. التسجيل والحساب
- لازم تكون عندك ١٨ سنة أو أكتر لاستخدام التطبيق.
- أنت مسؤول عن دقة البيانات اللي بتقدمها وقت التسجيل.
- أنت مسؤول عن الحفاظ على سرية بيانات حسابك (كلمة السر، رمز التحقق).
- أي نشاط بيتم من حسابك يُعتبر صادر منك.
- يحق لنا تعليق أو إلغاء حسابك لو اكتشفنا مخالفة للشروط دي.
٤. الطلبات والعروض
- لما تبعت طلب، الصيدليات القريبة بتبعتلك عروض بأسعار ومواعيد توصيل مختلفة.
- أنت حر في اختيار العرض اللي يناسبك أو رفض كل العروض.
- بعد قبول العرض، الطلب بيكون ملزم ومش بيتلغى إلا في الحالات المحددة.
- قبل ما تقبل أي عرض، بيظهر لك بيان بالأصناف وأسعارها ورسوم التوصيل إن وُجدت، والإجمالي النهائي شامل الضرائب المطبقة.
- العروض والخصومات على المنتجات بتقدّمها وتموّلها الصيدلية، ولازم تلتزم بقواعد التسعير والموافقات الواجبة التطبيق حيث تنطبق. مش بدهلها تغيّر السعر أو الأصناف بعد قبولك من طرف واحد — أي تعديل محتاج توضيحه وموافقتك الصريحة، مع حفظ حقوقك القانونية.
٥. الروشتات (الوصفات الطبية)
- بعض الأدوية بتحتاج روشتة طبية سارية. الصيدلية وصيدليها المرخّص بيتحققوا من متطلبات الروشتة، ولازم يمتنعوا عن الصرف لو المتطلبات القانونية مش مكتملة.
- أنت مسؤول عن صحة ووضوح صورة الروشتة اللي بترفعها.
- الصيدلية ليها الحق تطلب روشتة أصلية عند التسليم للأدوية المقيدة.
- الصيدلية مسؤولة عن مصدر المنتجات وتخزينها وصلاحيتها وجودة الصرف والبدائل المسموح بيها، وبتصدر فاتورة ببيع المنتجات.
٦. الدفع
- طرق الدفع: كاش عند الاستلام، ماكينة POS، إنستاباي، أو محفظة إلكترونية — بحسب المتاح لطلبك، والتحصيل بيتم مع الصيدلية عند التسليم.
- المبلغ النهائي بيشمل سعر الأدوية + رسوم التوصيل (لو موجودة).
- إحنا مش بنستقبل ولا بنخزّن بيانات بطاقاتك — الدفع بيتم مباشرة بينك وبين الصيدلية بطرق الدفع المتاحة.
٧. التوصيل
- مواعيد التوصيل المعروضة تقديرية وممكن تتأثر بعوامل خارجة عن إرادتنا.
- المستخدم مسؤول عن توفير عنوان صحيح ورقم موبايل شغّال.
٨. الإلغاء والاسترجاع
- تقدر تلغي الطلب قبل ما الصيدلية تبدأ تجهيزه.
- بعد بدء التجهيز، الإلغاء بيتم بحسب الحالة وسياسة الصيدلية — من غير أي تنقص من حقوقك القانونية.
- الإرجاع والاسترداد بيخضعوا للقواعد القانونية المطبقة على نوع المنتج وحالته — والمعالجة مش مقصورة على التلف الظاهر، وبتشمل العيوب وأخطاء الصرف وعدم التسليم في الحالات اللي بيقررها القانون.
- تقدر تقدّم شكوتك لدوا بلس، وإحنا بنتابعها مع الصيدلية و بنفّذ التزاماتنا الخاصة بالخدمة والدفع والاسترداد حيث تنطبق.
٩. سلوك المستخدم
بتوافق إنك مش هتستخدم التطبيق في:
- تقديم بيانات مزيّفة أو روشتات مزوّرة.
- أي نشاط غير قانوني أو مخالف للقوانين المصرية.
- إزعاج أو إساءة للصيدليات أو مندوبي التوصيل.
- محاولة اختراق التطبيق أو التلاعب بنظامه.
- طلب أدوية مقيدة بدون وصفة طبية سارية.
١٠. حدود المسؤولية
دوا بلس منصة وسيطة. البيع والصرف وجودة المنتجات والتوصيل اللي بتتولاه من مسؤوليات الصيدلية.
- دوا بلس مش مسؤول عن أي ضرر ناتج عن استخدام أدوية بدون استشارة طبية.
- مش بنضمن توفر أي دوا معين في أي وقت.
- مش مسؤولين عن تأخير التوصيل الناتج عن ظروف خارجة عن إرادتنا.
- مسؤولية كل طرف بتتحدد وفق القانون والوقائع. الشروط دي مش بتستبعد مسؤولية دوا بلس عن أعمالها أو تقصيرها أو مساهمتها في الضرر، ولا أي مسؤولية أو حق للمستهلك بيقرره القانون ومش جائز استبعاده.
١١. الملكية الفكرية
كل المحتوى الموجود في التطبيق والموقع — بما فيه الشعار، التصميمات، النصوص، والأيقونات — ملكية خاصة لدوا بلس ومحمية بقوانين الملكية الفكرية المصرية والدولية. مش مسموح نسخ أو إعادة استخدام أي جزء بدون إذن كتابي.
١٢. تعديل الشروط
يحق لنا تعديل الشروط دي في أي وقت. هنبلّغك بأي تغييرات جوهرية عن طريق التطبيق. استمرارك في استخدام التطبيق بعد التعديل معناه موافقتك على الشروط الجديدة.
١٣. القانون المعمول به
الشروط دي خاضعة للقوانين المصرية. أي نزاع بيتم حله عن طريق المحاكم المختصة في جمهورية مصر العربية.

1. Definitions
- "App": The Dawa Plus mobile application and website.
- "User": Any person who uses the app to order or search for medicines.
- "Pharmacy": Any licensed pharmacy registered on the platform that provides offers to users.
- "Order": Any purchase request for medicines or health products through the app.
- "We" or "Dawa Plus": Dawa Plus for Applications Production — Single Member LLC (Commercial Registry No. 33697), the company operating the Dawa Plus app.
2. Nature of Service
Dawa Plus is an intermediary platform connecting users with licensed partner pharmacies:
- The pharmacy that accepts your order sells and dispenses the products through a licensed pharmacist, and is responsible for dispensing, product quality, and the delivery it undertakes.
- We operate matching, offer presentation and processing, communication, tracking, support, and applicable settlement services, and facilitate delivery between the pharmacy and the user.
- We are not a pharmacy: we do not prescribe, dispense, or provide pharmaceutical advice.
- Each party is responsible for the activities it performs and its legal obligations — liability is determined by the applicable law and facts.
The app is not a substitute for medical advice. Always consult your doctor before using any medication.
3. Registration & Account
- You must be 18 years or older to use the app.
- You are responsible for the accuracy of the information you provide during registration.
- You are responsible for maintaining the confidentiality of your account credentials (password, verification code).
- Any activity conducted through your account is considered to originate from you.
- We reserve the right to suspend or terminate your account if we detect a violation of these terms.
4. Orders & Offers
- When you submit an order, nearby pharmacies send you offers with different prices and delivery times.
- You are free to accept the offer that suits you or decline all offers.
- After accepting an offer, the order becomes binding and cannot be cancelled except in specified cases.
- Before accepting an offer, you’ll see the items and their prices, any delivery fee, and the final total, including applicable taxes.
- Offers and product discounts are provided and funded by the pharmacy, which must comply with applicable pricing rules and approvals. The pharmacy must not unilaterally change accepted prices or items — any change requires clear disclosure and your express agreement, without reducing your statutory rights.
5. Prescriptions
- Some medicines require a valid medical prescription. The pharmacy and its licensed pharmacist verify prescription requirements and must refuse dispensing when legal requirements are not met.
- You are responsible for the accuracy and clarity of uploaded prescription photos.
- The pharmacy may request the original prescription upon delivery for controlled medicines.
- The pharmacy is responsible for product sourcing, storage, expiry, correct dispensing and lawful substitutions, and issues the product-sales invoice.
6. Payment
- Payment methods: cash on delivery, POS machine, InstaPay, or an electronic wallet — depending on availability for your order. Payment is collected with the pharmacy at delivery.
- The final amount includes the medicine price + delivery fee (if applicable).
- We do not receive or store your card details — payment happens directly between you and the pharmacy using the available methods.
7. Delivery
- Displayed delivery times are estimates and may be affected by factors beyond our control.
- The user is responsible for providing an accurate address and active phone number.
8. Cancellation & Returns
- You may cancel an order before the pharmacy begins preparation.
- After preparation has started, cancellation depends on the circumstances and the pharmacy's policy — without reducing your statutory rights.
- Returns and refunds follow the legal rules applicable to the product and its condition — remedies are not limited to visible damage and cover defects, dispensing errors, and non-delivery where the law so provides.
- You can submit a complaint to Dawa Plus; we follow up with the pharmacy and perform our own service, payment, and refund duties where applicable.
9. User Conduct
You agree not to use the app for:
- Providing false information or forged prescriptions.
- Any illegal activity or violation of Egyptian law.
- Harassing or abusing pharmacies or delivery personnel.
- Attempting to hack the app or tamper with its systems.
- Ordering controlled medicines without a valid prescription.
10. Limitation of Liability
Dawa Plus is an intermediary platform. Product sales, dispensing, quality, and the delivery the pharmacy undertakes are the pharmacy's responsibility.
- Dawa Plus is not liable for any harm resulting from using medicines without medical consultation.
- We do not guarantee the availability of any specific medicine at any time.
- We are not responsible for delivery delays caused by circumstances beyond our control.
- Each party's liability is determined by the applicable law and facts. These terms do not exclude Dawa Plus's responsibility for its own acts, omissions, or contribution to harm, or any statutory consumer right or liability that cannot lawfully be excluded.
11. Intellectual Property
All content on the app and website — including the logo, designs, text, and icons — is the exclusive property of Dawa Plus and is protected by Egyptian and international intellectual property laws. No part may be copied or reused without written permission.
12. Changes to Terms
We reserve the right to modify these terms at any time. You will be notified of material changes through the app. Continued use of the app after modifications constitutes acceptance of the new terms.
13. Governing Law
These terms are governed by Egyptian law. Any disputes shall be resolved through the competent courts of the Arab Republic of Egypt.
